{"id":15505,"date":"2026-06-26T00:39:55","date_gmt":"2026-06-26T00:39:55","guid":{"rendered":"https:\/\/sriwijayapertama.net\/?p=15505"},"modified":"2026-06-26T00:39:55","modified_gmt":"2026-06-26T00:39:55","slug":"ma-kabulkan-pk-menteri-atr-bpn-sofhuan-yusfiansyah-nilai-shgu-pt-skb-dibatalkan-secara-permanen","status":"publish","type":"post","link":"https:\/\/sriwijayapertama.net\/index.php\/2026\/06\/26\/ma-kabulkan-pk-menteri-atr-bpn-sofhuan-yusfiansyah-nilai-shgu-pt-skb-dibatalkan-secara-permanen\/","title":{"rendered":"MA Kabulkan PK Menteri ATR\/BPN, Sofhuan Yusfiansyah Nilai SHGU PT SKB Dibatalkan Secara Permanen"},"content":{"rendered":"<p><strong>PALEMBANG ,SRIWIJAYAPERTAMA.NET<\/strong>\u2014 Mahkamah Agung (MA) Republik Indonesia melalui mengabulkan permohonan Peninjauan Kembali (PK) yang diajukan Menteri Agraria dan Tata Ruang\/Kepala Badan Pertanahan Nasional (ATR\/BPN) dalam sengketa tata usaha negara terkait pembatalan Hak Guna Usaha (HGU) milik PT Sentosa Kurnia Bahagia (SKB) di Kabupaten Musi Banyuasin, Sumatera Selatan.<\/p>\n<p>Putusan tersebut tertuang dalam amar Putusan PK Nomor 68 PK\/TUN\/2026 yang mengabulkan permohonan PK Menteri ATR\/BPN, membatalkan Putusan Kasasi Nomor 554 K\/TUN\/2024, serta menolak gugatan PT Sentosa Kurnia Bahagia.<\/p>\n<p>Dengan putusan itu, Keputusan Menteri ATR\/BPN Nomor 1\/Pbt\/KEM-ATR\/BPN\/VI\/2023 tentang pembatalan Sertifikat Hak Guna Usaha (SHGU) Nomor 00146\/MUBA atas nama PT Sentosa Kurnia Bahagia seluas sekitar 3.859,7 hektare di Kabupaten Musi Banyuasin dinyatakan tetap berlaku dan berkekuatan hukum tetap (inkracht).<\/p>\n<p>Menyikapi putusan tersebut, Kuasa Hukum PT Gorby Putra Utama (GPU), Dr. (c) Sofhuan Yusfiansyah, SH., MH, mengatakan putusan Mahkamah Agung tersebut menjadi bagian penting dalam memberikan kepastian hukum terhadap objek yang selama ini menjadi sengketa.<\/p>\n<p>\u201cPutusan ini menunjukkan bahwa proses hukum telah berjalan sesuai mekanisme yang berlaku. Mahkamah Agung mempertimbangkan berbagai fakta hukum, termasuk adanya novum atau bukti baru serta putusan-putusan lain yang telah berkekuatan hukum tetap,\u201d ujar Sofhuan dalam keterangannya, pada Kamis (25\/6\/2026).<\/p>\n<p>Menurut Sofhuan, dalam pertimbangannya Mahkamah Agung juga memperhatikan sejumlah fakta hukum yang terungkap dalam perkara lain yang berkaitan dengan objek sengketa, baik perdata maupun pidana.<\/p>\n<p>Karena itu, putusan PK tersebut diharapkan dapat mengakhiri ketidakpastian hukum yang selama ini terjadi.<\/p>\n<p>\u201cDengan adanya putusan yang telah berkekuatan hukum tetap, tidak tersedia lagi upaya hukum biasa maupun luar biasa terhadap perkara ini.<\/p>\n<p>Putusan tersebut bersifat final dan mengikat, sehingga kami berharap seluruh pihak menghormati proses hukum yang telah berjalan,\u201d katanya.<\/p>\n<p>Ia menambahkan, dengan dikabulkannya PK Menteri ATR\/BPN dan tetap berlakunya keputusan pembatalan SHGU tersebut, maka status HGU PT Sentosa Kurnia Bahagia dinyatakan batal berdasarkan keputusan yang telah memperoleh kekuatan hukum tetap.<\/p>\n<p>&#8220;Dengan dikabulkannya PK ini dan tetap berlakunya keputusan pembatalan SHGU oleh Menteri ATR\/BPN, maka secara hukum SHGU PT SKB dinilai tidak lagi berlaku atau dibatalkan atau dicabut secara permanen. Putusan tersebut bersifat final dan mengikat,&#8221; pungkas Sofhuan dengan tegas.<\/p>\n<p>Sementara itu, Tokoh Masyarakat Musi Rawas Utara (Muratara), Abdul Aziz, SH, menyambut baik putusan Mahkamah Agung yang mengabulkan PK Menteri ATR\/BPN dan menguatkan pembatalan HGU PT SKB.<\/p>\n<p>\u201cPutusan ini memberikan kepastian hukum dan patut dihormati oleh semua pihak. Kami berharap persoalan yang selama ini menimbulkan polemik dapat diselesaikan sesuai koridor hukum yang berlaku,\u201d ujar Abdul Aziz.<\/p>\n<p>Putusan PK Nomor 68 PK\/TUN\/2026 tersebut sekaligus menandai berakhirnya proses sengketa tata usaha negara terkait pembatalan HGU PT SKB yang sebelumnya bergulir mulai dari tingkat pertama, kasasi, hingga peninjauan kembali di Mahkamah Agung.
